Divorce!!!?

i have been seperated from my wife for nearly a year and someone told me that if your seperated for 2 years the marriage gets disolved without a divorce does anyone know if this is true

    You still need to get divorced. It’s just the process is quicker - which is why it is often known as a quickie divorce.

    If you and your wife together filed a legal separation then you could avoid divorce proceeding. After one year legally separated and living in separate residences you can file to change your legal separation to a legal divorce.
    The benefit to this you can usually avoid court and there is usually a lot less to pay in lawyers fees. You may even be able to do the paperwork yourself or higher a mediator to assist you. And when the year is up no one has to file against the other person or even have grounds to file.
    The down side is that you have to be in agreement on everything from custody or who gets the china and the 401k. If your finances are complicated or if you don’t agree on custody or child support, you may spend just as much on lawyers and mediators to hash it all out.
    In your case, if you have a formal legal separation then all you have to do is petition your local supreme court to make your divorce final. But, if you did not file a separation petition already, then you would still have to file now and wait a year before your divorce was final.

    Not true. In fact (legally) you can FILE for divorce only after being separated for at least 2 years. If you both agree between the two of you to say to the courts that 2 years have passed (even thou thats not that case), its entirely up to you both. Nobody will be any wiser. Once you file for a divorce it can take anything from a few months to a couple of years depending on how both of you negotiate (are there kids involved, asset division etc). Sorry, but not as simple as that, although there is a time period that can lapse which will make the divorce quite speedy (I think it is 5 years but I am uncertain on this one).

    In the UK that is absolutely not true! Matters not if seperated for 2 or 20 years the marriage is not dissolved until the divorce process has been gone through.

    A marriage cannot be dissolved just becuase you are no longer living together. You will remain legally married untill one of you divorces the other.

    no hun, my sis went thro the same thing. U still need to get a divorce tho, its just quicker and cheaper to do it this way. check online, she did, it only cost her a couple of hundred quid, cheaper than solicitors!

    no dont think so….I think it just speeds up the process. You still need to go through the legal procedure of divorce….only a judge can do that not ol’ father time im afraid

    its not exactly true!! you still have to go through solicitors an swear an oath in court!!……….but it only takes a day or 2!! you just go to your solicitors and they will write to your wife…if she does’nt sign the papers then you will have to go in2 a little room in the courts and take an oath………..after a couple more weeks if your wife has still not been in touch then your automatically classed as divorced and will recieve you decree nisa through the post meaning your a free MAN!! hahahahahahahaha.good luck x

    2 years is the figure but you must get divorced but whether its quicker is open to spec
